Welcome to The Guestbook, the online and mobile service of Guestbook Rewards, Inc. (“The Guestbook,” “we,” or “us”). Our Privacy Policy explains how we collect, use, disclose, and protect information that applies to our Service, and your choices about the collection and use of your information.

For all purposes, the English language version of this Privacy Policy shall be the original, governing instrument and understanding of the parties. In the event of any conflict between the English language version of the Privacy Policy and any subsequent translation into any other language, the English language version shall govern and control.

HOW WE COLLECT AND USE INFORMATION

Capitalized terms that are not defined in this Privacy Policy have the meaning given them in our Terms of Use at https://theguestbook.com/terms.

We collect the following types of information about you:

Information you provide us directly: When you register for an account with The Guestbook, we ask for your e-mail address and ask that you create a password. Alternatively, you may register using a third-party service for authentication, such as Gmail, Yahoo, Outlook, and Hotmail (see “Information we may receive from third parties” below). Once you are registered, we allow you to provide us with additional information such as your first and last name, address, hotel preferences, birthdate (month and day), phone number and additional e-mail addresses. We may retain any messages you send through the Service, and may collect information you provide in any content you provide to the Service. We use this information to operate, maintain, and provide to you the features and functionality of the Service, as well as to communicate directly with you, such as to send you email messages and push notifications. We may send you emails containing newsletters, promotions and special offers. If you do not want to receive such email messages, you will be given the option to opt out or change your preferences. We also use your information to send you Service-related emails (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Service, technical and security notices). You may not opt out of Service-related e-mails. If you choose to make a reservation with a Participating Property through The Guestbook's website, you may provide credit card and other information associated with such reservations. The requisite information will be passed through to the Participating Properties to fulfill its reservation requirements, however, credit card information will never be seen nor stored by The Guestbook (see also “Sharing of your Information").

Information we may receive from syncing your e-mail account: If you enable e-mail sync for your e-mail account(s) in order to automate various functions of the Service, The Guestbook will utilize standard secure protocols, such as OAuth, to authorize access. The respective email service will seek permission for the functions requested by The Guestbook, which you will then authorize. Despite the access level granted via this process, The Guestbook commits to limit the sync process to “view” rights and will only access e-mails for the purpose of collecting information about hotel/travel reservations & billing in order to operate, maintain and provide our Service. You may cancel this integration at any time via the respective third-party email service. See Your Choices, below, or visit My Account on our website to learn more.

Information we may receive from third parties: We may receive information about you from third parties. For example, if you access our websites or Service through a third party connection or log-in such as Facebook, by “following,” or “liking,” us on social media, adding The Guestbook application, or linking your social media account to The Guestbook Service, etc., that third party may pass certain information about your use of its service to The Guestbook. This information could include, but is not limited to, the user ID associated with your account (for example, your Facebook UID), an access token necessary to access that service, any information that you have permitted the third party to share with us, and any information you have made public in connection with that service. If you allow us access to your friends list, your friends’ user IDs, and your connection to those friends, may be used and stored to make your experience more social, and to allow you to invite your friends to use our Service as well as provide you with updates if and when your friends join The Guestbook. You should always review, and if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to The Guestbook Service. You may also unlink your third party account from the Service by adjusting your settings on the third party service.

Information automatically collected: We automatically collect certain types of usage information when you visit our website or use our Service. When you visit the Service, we may send one or more cookies — a small text file containing a string of alphanumeric characters — to your computer that uniquely identifies your browser and lets The Guestbook help you log in faster and enhance your navigation through the site. A cookie may also convey information to us about how you use the Service (e.g., the pages you view, the links you click and other actions you take on the Service), and allow us or our business partners to track your usage of the Service over time. You can set your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled. We also may collect log file information from your browser or mobile device each time you access the Service. Log file information may include anonymous information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information. We may employ clear gifs (also known as web beacons), which are used to anonymously track the online usage patterns of our Users. In addition, we may also use clear gifs in HTML-based emails sent to our users to track, which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Service. We may also collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Service. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving the Service. Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser at this time.

When you access the Service by or through a mobile device (including but not limited to smart-phones or tablets), we may access, collect, monitor and/or remotely store one or more unique identification numbers associated with your device (“Device ID”), and/or information about your mobile carrier, device type and manufacturer, phone number, and depending on your mobile device settings, your geographical location data, including GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your device. Location data may convey to us information about how you browse and use the Service.

We use or may use cookies, log file, device identifiers, location data and clear gifs information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information, including advertising; (c) to provide and monitor the effectiveness of our Service; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) diagnose or fix technology problems; (f) help you efficiently access your information after you sign in; and (g) automatically update The Guestbook application on your mobile devices.

These Additional California Privacy Disclosures (“Disclosures”) supplement the information contained in our Privacy Policy by providing additional information about how we collect, use, disclose, and otherwise process personal information of individual residents of the State of California within the scope of the California Consumer Privacy Act of 2018 (CCPA). Unless otherwise expressly stated, all terms defined in our Privacy Policy retain the same meaning in these Disclosures and all other terms defined in the CCPA and not otherwise defined in these Disclosures have the same meaning when used in these Disclosures.

We use these third-party providers to analyze and optimize our online services, provide more relevant content and ads to users of our online services and other third parties, and perform other services related to analytics or advertising consistent with these Disclosures and our Privacy Policy. These third-party businesses may use the information they collect directly from you for their own purposes in accordance with their own privacy notices, which may include using this information for services provided to other third parties, including other parties operating in advertising networks.

Sources of Personal Information

As described in the How We Collect and Use Information section of our Privacy Policy we collect personal information directly from you when you provide it to us, automatically when you visit our websites and other online services, and from service providers and other third parties. For representatives of our clients, vendors, service providers and other third parties, we also collect personal information directly from you and from the entity you represent.

Purposes for Collecting Personal Information

We collect personal information about you for the purposes described in the How We Collect and Use Information section of our Privacy Policy. For representatives of our clients, vendors, service providers and other third parties, we also collect your personal information to maintain an ongoing relationship between us and the entity you represent and to contact you in connection with our relationship with the entity you represent.

Recipients of Personal Information

As described in the Sharing of Your Information section of our Privacy Policy, we share personal information within The Guestbook group of companies and with a variety of third parties. For representatives of our clients, vendors, service providers and other third parties, we also share your personal information with the entity you represent.

Your Privacy Rights

As a California resident, you may be able to exercise the following rights in relation to the Personal Information about you that we have collected (subject to certain limitations at law):

Right to Know

The right to request any or all of the following personal information we have collected and disclosed about you in the last 12 months:

  • The specific pieces of personal information we have collected about you;
  • The categories and specific pieces of personal information we have collected about you;
  • The categories of sources of the personal information we have collected about you;
  • The categories of personal information we have disclosed about you to third parties for a business purpose, and the categories of recipients to whom this information was disclosed;
  • The categories of personal information we have sold about you (if any), and the categories of third parties to whom this information was sold; and
  • The business or commercial purposes for collecting or, if applicable, selling personal information.

Right to Deletion

The right to request the deletion of personal information we have collected from you, subject to certain exceptions.

The right to direct us not to sell personal information we have collected about you to third parties.

Right to Non-Discrimination

The right to be free from discrimination for exercising any of the rights described above.

The right to non-discrimination does not prohibit us from offering you certain financial incentives that may result in different prices, rates or quality levels of products or services. In addition, please note that if the exercise of the rights described above limits our ability to process personal information (such as in the case of a deletion request), we may not be able to provide our products and services to individuals who exercise these rights, or to otherwise engage with such individuals going forward.

In certain circumstances, we may decline a request to exercise the right to know and/or right to deletion, particularly where we are unable to verify your identity.

Submitting Requests

To Exercise Your Right to Know or Right to Deletion

To submit a request to exercise your right to know or right to deletion, please submit a request by emailing us at contact@theguestbook.com or by submitting a request via our California Consumer Rights Request Form.

Before processing your request, we will need to verify your identity and confirm you are a resident of the State of California. In order to verify your identity, we will generally either require the successful authentication of your membership, or the matching of sufficient information you provide us to the information we maintain about you in our systems. This process may require us to request additional personal information from you, including, but not limited to, your email, address, member number, product website name, and/or date of last interaction with customer service.

Authorized Agents

In certain circumstances, you are permitted to use an authorized agent (as that term is defined by the CCPA) to submit requests on your behalf through the designated methods set forth in these Disclosures where we can verify the authorized agent’s authority to act on your behalf by:

  1. For requests to know or delete personal information:
    1. receiving a power of attorney valid under the laws of California from you or your authorized agent; or
    2. receiving sufficient evidence to show that you have:
      1. provided the authorized agent signed permission to act on your behalf;
      2. verified your own identity directly with us pursuant to the instructions set forth in these Disclosures; and
      3. directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.
  2. For requests to opt-out of personal information “sales”: receiving a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf.

We will update these Disclosures from time to time. When we make changes to these Disclosures, we will change the “Last Modified” date. If we make material changes to these Disclosures, we will notify you by prominent posting at the beginning of these Disclosures or our Privacy Policy.
